PACT Act Statement

To Our Valued Customers, In light of the 2020 amendment to the Prevent All Cigarette Trafficking (PACT) Act, we want to apprise you of the coming changes to how we will be able to sell and ship our CBD vape pens and cartridges. The previous 2009 PACT Act imposed registration regulations and mailing restrictions on cigarette and smokeless tobacco companies and products. The most prominent of those restrictions was the prohibition of these products from being carried by the United States Postal Service (USPS). The 2020 amendment to the PACT Act re-defines the term “cigarette” to include Electronic Nicotine Delivery Systems (ENDS). All vaping products (liquids, cartridges, accessories, etc.) are considered ENDS – even if they do not contain nicotine. Our CBD vape products are included in the ENDS category. Beginning on March 28th, 2021, all ENDS products will be officially prohibited from shipping through the USPS (as they are now included under the definition of “cigarette”). This poses a major complication for our company as the USPS is our main method of delivery across the United States. The amended PACT Act also requires new forms of business registration and sales/delivery reporting, with which we are working on becoming fully compliant. Those new regulations include registering our business with the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) and the tobacco tax administrators in all states we do business in, in our case, all 50 states. To complicate things even further, Federal Express (FedEx), DHL, and United Parcel Service (UPS) have both recently announced that they will no longer be delivering ENDS products. FedEx will cease ENDS transportation as of March 1st, 2021, and UPS will cease ENDS transportation beginning on April 5th, 2021. As we devise a new delivery system and get our business to meet the new codes, we ask for your patience and understanding. Although our plans for tackling these changes are already in motion, we will be temporarily UNABLE to sell any vape cartridges and/or vape accessories after March 26th, 2021. All vape cartridge and vape accessory sales will need to be temporarily halted from that date onward until we are fully compliant with the new regulations. We will keep you updated as things move along and we will let you know as soon as we can begin selling our CBD vape products once again. If you are interested in purchasing any of our vape products, we urge you to please do so before March 26th. March 26th will be the last day you can place a Cheef Botanicals order for any vape cartridges or accessories – at least until we are compliant with the new federal regulations. Once we are able to begin CBD vape deliveries again, please be aware that there are also new regulations requiring age verification. One of the main goals of the PACT Act is to prevent tobacco and ENDS products from ending up in the hands of children – which we completely understand and support.
